Auto AI LLC ("Auto AI", "we", "us", "our") operates Auto AI Radar (the "Service") at radar.autoai.inc and related properties. This Privacy Policy describes the personal information we collect, how we use it, the limited circumstances under which we disclose it, and the choices and rights available to you. By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy.

If you do not agree with any part of this Privacy Policy, you must immediately stop accessing or using the Service.

1. Who this policy applies to

This Policy applies to (a) franchised automotive dealerships and their authorized personnel who subscribe to or evaluate the Service ("Customers") and (b) visitors to our marketing website. The relationship between Auto AI and each category is materially different and is described separately below.

As a core feature of the Service, Auto AI continuously tracks the Customer's own public-facing website and the public-facing websites and advertisements (including advertised specials) of the competitors the Customer identifies. Our pre-built algorithm scans advertised specials, promotional offers, disclosures, pricing claims, and other publicly displayed content for signals that may relate to U.S. Federal Trade Commission ("FTC") advertising-compliance guidance and analogous state automotive-advertising rules. This is a helpful monitoring tool, not legal advice and not a guarantee of compliance. The algorithm is probabilistic and does not guarantee 100% accuracy; it may produce false positives, miss issues that exist, or fail to detect a non-compliant ad or website element. Auto AI is not responsible or liable for any regulatory action, investigation, lawsuit, fine, penalty, or third-party claim arising from a compliance issue the Service did or did not catch. The Customer remains solely responsible for the legality of its own advertising and for independently evaluating any competitor activity it chooses to act on.

2.4 Information gathered from public sources (Market Intelligence)

To operate the Service, Auto AI collects information that is publicly available on the internet, including but not limited to: advertised promotional offers and specials published on dealership and competitor websites; advertisements published in Meta's public Ad Library transparency tool and other public ad-transparency sources; public real estate listings, public records, local news, and other publicly accessible market signals. This information is not collected from Customers and does not constitute personal information of Customers. To the extent any such information incidentally identifies a natural person, Auto AI processes it solely to provide aggregate market intelligence and compliance signals to the Customer and not to evaluate, profile, or target that individual.

3. How we use information

Auto AI uses information solely to: (a) provide, maintain, secure, and improve the Service, including the FTC compliance monitoring feature described in Section 2.3; (b) authenticate users and enforce access controls; (c) bill Customers and prevent fraud; (d) respond to support requests; (e) generate aggregated, de-identified analytics; (f) comply with legal obligations; and (g) enforce our Terms of Service. We do not sell personal information.

4. Roles under privacy law (Controller / Processor)

With respect to Customer account data and usage telemetry, Auto AI acts as the business / controller. Public competitor and market-intelligence data processed under Section 2.3–2.4 is not personal information of the Customer or its end users and is processed by Auto AI in its own capacity to operate the Service.

Auto AI does not sell personal information and does not share personal information for cross-context behavioral advertising. We disclose information only as follows:

The Service is hosted in the United States. If you access the Service from outside the United States, you understand and consent to the transfer of your information to the United States, which may have different data-protection laws than your jurisdiction.

8. Data retention

We retain personal information for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Compliance-monitoring records (snapshots of Customer and competitor public web pages and ads) are retained for the period necessary to support trend analysis and historical comparison and may be retained indefinitely in aggregated form. Aggregate, de-identified data may be retained indefinitely.

9. Security

Auto AI maintains administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (TLS 1.2+), encryption at rest, role-based access controls, row-level security at the database layer, vendor security reviews, and logging. No method of transmission or storage is completely secure, and we cannot and do not guarantee absolute security. You are responsible for safeguarding your account credentials.

10. Your rights

Depending on your jurisdiction, you may have the right to (a) access the personal information we hold about you, (b) request correction or deletion, (c) request a copy in a portable format, (d) object to or restrict certain processing, (e) opt out of any "sale" or "sharing" (we do neither), and (f) withdraw consent where processing is based on consent. Customers may submit verifiable requests by emailing privacy@autoai.inc. We will respond within the timeframes required by applicable law and may need to verify your identity before fulfilling the request.

11. Children

The Service is intended exclusively for business use by adults. It is not directed to children under 16, and we do not knowingly collect personal information from anyone under 16. If you believe a child has provided us with personal information, contact us and we will delete it.

12. California-specific disclosures

In the preceding twelve months, Auto AI has collected the categories of personal information described in Section 2 and has disclosed them only to the subprocessors described in Section 6. Auto AI has not sold personal information and has not shared personal information for cross-context behavioral advertising. California residents may exercise the rights described in Section 10. We do not discriminate against any individual for exercising a privacy right.

13. AI processing disclosure

Portions of the Service, including the FTC compliance monitoring feature described in Section 2.3, use large-language-model and other AI systems to analyze, classify, and summarize information. Output generated by these systems is probabilistic, may be inaccurate or incomplete, and must not be treated as legal or professional advice. The Customer remains solely responsible for any business or compliance decision made on the basis of Service output, and Auto AI is not liable for any consequence of relying on it.

14. Third-party links and sources

The Service may link to or display information sourced from third-party websites that Auto AI does not control. Those third parties have their own privacy policies, and Auto AI is not responsible for their practices.

15. Changes to this Policy

We may update this Privacy Policy from time to time. We will post the updated version with a new "Effective Date." Material changes will be communicated to account owners by email. Your continued use of the Service after an update constitutes acceptance of the revised Policy.
